Subject: Urgent Intervention and Assistance High level inquiry deceitful practice in Non-Delivery of Vehicles even after 6 months after booking and taking full payment of Rs.*******/- for 4 Ecco Vehicles,then cancellation of Bookings, now deception in Refund Issues again.
Urgent Plea for help in releasing Immediate Refund of Loan Amount as unfair trade / unethical business practice doing by Maruti company and its authorized dealer - A Cry for Help as a last resort.
Hon'ble Chairman Lalpura,
We writing to bring to your attention a matter of utmost urgency and seek your intervention in resolving a long-standing issue faced by a group of four unemployed individuals from Leh UT Ladakh. As always the Maruti Company and its authorized dealer M/s Higland Automobiles Ltd.,Sonwar Srinagar,has failed to meet up their promises again by not refunding the said amount on 26/09/2023 and we are seeking urgent help as a last resort in getting refund of our loan amount, through the depths of our despair, hoping to reach the empathetic chambers of your hearts. Our plea is born out of an unimaginable ordeal and an urgent need for intervention.
The individuals are Stanzin Lundup, Spales Angmo, Jigmet Palden, and Jigmet Mepham, had booked four 7-seater commercial Eco vehicles through Maruti Company India Ltd.'s authorized showroom dealer, M/s Highland Pvt. Automobiles in Sonwar Srinagar, Jammu & Kashmir. The bookings were made in March 2023, and on the instruction of them the full payment of Rs. 22,58,900/- (4*5,64,725) was released to the dealer for delivery of the Vehicles.
Despite the full payment of loan and assurances from the dealer, the vehicles have not been delivered even after a period of more than six months. This delay has caused severe financial distress and mental turmoil for the individuals involved.
Furthermore, the lack of transparency, responsiveness, and professionalism from both Maruti Company India Ltd. and the authorized dealer, M/s Highland Pvt. Automobiles, has led to frustration and hopelessness among the affected individuals. The Maruti company and its dealer have failed to adhere to the agreed-upon terms and conditions of their own company policies ( Terms and conditions of vehicle delivery and refund enclosed hereby)for both the delivery of vehicles and the refund process. As per contract of the booking of the car, the time (delivery of car within 8 weeks) was the essence of the contract and as such any breach thereof in delivering the car within the stipulated period would tantamount to breach of contract and again after cancellation of booking,for refund they have mentioned It takes 25-30 days for the amount to get refunded but it took more than 2 months in refund still not sure about specific date for refund would tantamount to breach of breach of trust also by the Maruti Company and its authorized dealer.
The company does nothing except forwarding of our complains to its dealer and close the complains without any resolution and we have been complain to Maruti company since march but nothing happens except closing of our complains till date,strange and saddest thing is that still the company cares nothing nor they are took matter as serious till whole 6 months rather they some of Territorial Sales Manager Threat and abuse us in very bad manner like we are beggar and begging them for Vehicles but we were asking for vehicles for which we had already paid or asking for refund for our own money.
We have exhausted all possible channels for resolution by approaching the company, its dealer, and even relevant authorities. However, the response received so far has been unsatisfactory, and the affected individuals feel helpless in the face of this protracted ordeal.
Our financial situation has become increasingly dire. Despite our commitment to the loan and the interest that continues to accumulate, the vehicles have not been delivered to us and now after cancellation of booking nor they are refunding. This has led to severe financial stress and mental distress, as we are unable to generate income to repay the loan or even make loan installments.
In light of the circumstances, we kindly request your esteemed office's urgent intervention to bring about a swift resolution to this matter. The affected individuals are facing financial hardships, and their legitimate concerns have been ignored for far too long. We seek your intervention to ensure that justice is served and that the individuals receive either the delivery of the vehicles or a prompt refund of the entire amount.
We understand the importance of the National Commission for Minorities in addressing issues of discrimination and injustice faced by minority communities. In this case, the affected individuals belong to the poor family of Buddhist minority section of Leh Ladakh, and their plight needs your empathetic consideration and intervention.
Our request is twofold for the benefits:
1. Urgent intervention to ensure the swift or a prompt refund of the entire amount paid by the individuals with interest,compensation for loss of damage, mentally harassment etc till date.
2. Highl level Investigation into the conduct of Maruti Company India Ltd. and its authorized dealer, M/s Highland Automobiles Ltd. As the maruti company and its dealers follow the specified terms and condition during taking booking and receiving payment but they never follow the terms and condition during delivery of Vehicles and refunding time, therefore to avoid such scam or fraud to prevent such incidents from happening to other consumers in future, particularly those from minority communities.
We believe that your esteemed office can play a pivotal role in bringing about a fair and just resolution to this matter. Your intervention would not only provide relief to the affected individuals but also serve as a deterrent against such practices in the future
